- Please talk to a lawyer before making any decisions but feel free to use my experience below as a potential solution :
- I formed an LLC along with 2 others, capitalized it with ~100K with likelihood of future contracts (could use funding likelihood instead). In terms of structure, there were 4 classes of interests. the first class was the class whose votes mattered for decisions like hiring/firing a manager of the other classes. This class' units were divided equally among the 3 people and hence an employer employee relationship exists for all 3 if needed.
- The other 3 classes were owned 100% by each of the 3 members. This way 100% of any future income streams can be assigned to any 1 of these classes and so, you can pretty much get 100% of the economics (you can have a clause saying that these shares can't be reassigned without everyone agreeing) with 2 passive members whom you trust.
- I used this structure to basically be a sole founder with 2 economically inactive members. Then we set up a simple hierarchy and the person I was reporting to signed my H1 petition. We initially filed the petition with minimal information (no photos of office, no bank account statements, contracts etc) since apparently if you give a complex petition you raise more questions.
We got an RFE #1 asking about employer employee relationship that we responded to with a letter explaining the org/LLC structure. We got another RFE#2 asking about the employer employee relationship and this time we just sent the entire (massive) operating agreement along with minutes of the 1st LLC meeting that talked about reporting structure etc and it finally got approved. The visa stamping interview (in South Asia) was quick - took 15 seconds - they only asked if I was working for the LLC or a client (I said LLC).
I got a lawyer who came recommended having had success with similar cases but he didn't do a lot of work that I was hoping he would (I came up with the LLC structure myself after reading up on the H1B requirements and consulting with my business lawyer). I can't blame him though - these complicated H1Bs are a lot of work for a few $K of fees that they make.
So there you go - where there is a will there is a way. I won't be able to provide any more information but good luck!

- Algo/Staircase Traversal my head explodes just reading the explanation! My god. Skpping for now. Shall #revisit. This is the weakling #kryptonite
- I think I need a new approach or strategy to for remaining days. I find myself now struggling. The stuggle is not motivating and feels like a waste of time. I am also not sure if I am learning. What can I do different each day for algorithms? ==I wanna crush the problem!==. At lest gain more confidence in what I know for if I keep getting beaten in chess all day every day I will stop playing. I need to #fragthenoobs. Time to move to Competitive Programming? Hmm.
